Terms of Service

ZenSell.ai ("we", "our", "us", operated by ZenSell.ai, located at C. Alejandro Dumas, 17, Carretera de Cádiz, 29004 Málaga, Spain) provides the ZenSell.ai API, the WooCommerce ZenSellAgent plugin, and the ZenSell AI Shopify app (together, the "Service"). By installing the plugin/app, creating an account, or using the Service, you ("Merchant", "you") agree to these Terms of Service. If you do not agree, do not use the Service.

ZenSell.ai is an AI sales assistant that installs on a merchant's WooCommerce or Shopify store. It syncs the store's product catalog, answers shopper questions in a chat widget, and can add items to a shopper's cart or apply discount codes on the merchant's behalf. ZenSell.ai does not process payments itself — all checkout and payment processing happens through the merchant's own store and payment provider.

You must be at least 18 years old and have the authority to bind the business installing the Service. You are responsible for the accuracy of the information provided during setup (store URL, admin email, API credentials) and for keeping your account credentials secure.

The Service is offered on the Starter, Pro, and Business subscription plans described on our pricing page, billed monthly in advance via our payment processor (Stripe). Prices and conversation limits for each plan are as shown on https://zensell.ai/en/#pricing at the time of purchase. You may cancel your subscription at any time from your plugin dashboard or by contacting us; cancellation takes effect at the end of the current billing period and no partial refunds are issued for the remainder of that period, except as provided in Section 5. We reserve the right to change our prices with at least 30 days' notice by email to the admin email on file; continued use after a price change takes effect constitutes acceptance of the new price.

New subscriptions include a 14-day money-back guarantee from the date of first payment. To request a refund under this guarantee, contact suporte@zensell.ai within 14 days of your first charge.

You agree not to:

• use the Service to sell illegal goods or services;
• attempt to circumvent usage limits, security measures, or authentication mechanisms;
• reverse-engineer or resell access to the Service without our written consent;
• use the Service in a way that violates applicable consumer-protection, data-protection, or e-commerce law in your jurisdiction.

You are solely responsible for the accuracy of your product catalog, pricing, stock, and order fulfillment. ZenSell.ai's chat agent presents information synced from your store; you are responsible for keeping that data accurate and for honoring any commitments (prices, discounts, availability) the agent communicates to shoppers based on it.

Our collection and use of data is governed by our Privacy Policy (https://zensell.ai/en/privacy), which is incorporated into these Terms by reference. As between us, the Merchant remains the Data Controller for its end customers' personal data, and ZenSell.ai acts as a Data Processor as described in the Privacy Policy.

We own all rights to the ZenSell.ai software, branding, and documentation. You retain all rights to your store data, product catalog, and trademarks. You grant us a limited license to process your store and catalog data solely to provide the Service.

We aim for high availability but do not guarantee uninterrupted access. Business-plan subscribers receive the SLA described on the pricing page. We may suspend the Service for maintenance, non-payment, or violation of these Terms, with notice where reasonably possible.

The Service is provided "as is" and "as available." We do not guarantee that the AI agent's responses will always be accurate, that it will increase sales, or that it will be error-free. You should review AI-generated responses and configure guardrails appropriate to your store.

To the maximum extent permitted by law, ZenSell.ai's total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost sales.

We may suspend or terminate your access for material breach of these Terms, non-payment, or fraudulent/abusive use. Upon termination, your data is handled per the retention terms in our Privacy Policy.

These Terms are governed by the laws of Spain and the European Union, without regard to conflict-of-law principles. Any dispute shall be subject to the exclusive jurisdiction of the courts of Málaga, Spain, except where mandatory consumer-protection law in your country of residence grants you the right to bring a claim in your local courts.

We may update these Terms from time to time. Material changes will be notified by email to the admin email on file at least 15 days before taking effect.
